Welcome to rosalees.co.za. This website, related mobi-sites and software applications (the “website”, “site”) is owned and operated by ROSALEE’S.
These website terms and conditions (“Terms and Conditions”, “Terms of Service, “Terms”) govern the ordering, sale and delivery of products/goods, and the overall use of the website.
The Terms and Conditions are enforceable and binding against all persons that access or use this website (“customer”, “you”, “your” or “user”). By using this website and/or by clicking on the “Complete Order” button on the website, as applicable, you acknowledge that you read and agree to be bound by these Terms and Conditions.
GOVERNING LAW
These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the Republic of South Africa.
CHANGES TO THE TERMS AND CONDITIONS
You can review the most current version of the Terms and Conditions at any time on this page. We reserve the right to update, change or replace any part of these Terms by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.
USE OF THE WEBSITE
You may use this site solely for the purpose of learning about ROSALEE’S and/or purchasing our services and products. You may not use, reproduce, or distribute the text, graphics, downloads, tools, or any other content on the Website for any other purpose.
In order to access some features of the Website, you will have to create an account. When creating your account, you must provide accurate and complete information. If any of your information changes, you agree to update your registration information as soon as possible. If ROSALEE’S suspects that your registration information is not complete, current, or accurate, or that you have otherwise violated these Terms & Conditions, then your account may be subject to suspension or termination, and you may be barred from using the Website.
ROSALEE’S reserves the right to terminate a user’s access to the Website at any time in its sole discretion and without prior notice.
You may terminate your membership, this Agreement, and your right to use your membership at any time and for any reason or no reason, by contacting us at louis@rosalees.co.za.
INTELLECTUAL PROPERTY
All content on the site are owned by ROSALEE’S and subject to copyright and other intellectual property rights under South African and foreign laws and international conventions. Content on the Website is provided to you for your personal, non-commercial use only and may not be used, copied, sold, reproduced, distributed, transferred, broadcast, displayed, licensed, or otherwise misused for any purpose whatsoever without the prior written consent of ROSALEE’S.
If you download or print a copy of any portion of the Content for personal use, then you must maintain all applicable copyright and other copyrighted notices. You agree not to circumvent, disable or interfere with any security related features of the Website, or with any features that prevent or restrict use or copying of any Content.
The ROSALEE’S logo will be featured on all our products.
Please ensure you have the applicable copyright for all material supplied to us. ROSALEE’S does not take any responsibility for content supplied without proper copyright whatsoever and will not be held responsible for any subsequent disputes.
PRACTICES; TYPOGRAPHICAL ERRORS; COLOURS
In the event that a product is mistakenly listed at an incorrect price or with incorrect specifications, ROSALEE’S reserves the right to refuse or cancel any orders placed for products listed incorrectly, whether or not the order has been confirmed and your credit card charged. If your credit card has been charged for the purchase and your order is cancelled, ROSALEE’S shall issue a refund to you in the amount of the incorrect price charged. In no event shall ROSALEE’S be obligated to provide you the merchandise at the incorrect price.
We have made every effort to display as accurately as possible the colours and images of our products that appear at the store. However, the colours shown on the Site may be influenced by the settings of your computer or your monitor. Accordingly, ROSALEE’S makes no guarantees that any actual colours of products or features will be true or accurate.
Our products are handmade and will sometimes not exactly match the colour, shape, size or finish of that depicted in the product image and product description online. This is seen as a unique feature of hand-crafted products, rather than an imperfection or defective product. These variations may include but are not limited to, colour differences and imperfections in the natural wood. The shade of wood varies from batch to batch and we have no control over this.
QUOTATIONS
Quotations are free of charge and you are under no obligation, until the quotation is accepted and signed by you.
Quotations are valid for 15 days from the date on the quotation. A non-refundable deposit of 50% is required on acceptance of the quotation.
A quotation is only valid if it has been received by the customer in an unchangeable, secure format, and has not been changed in any way. Quotes are only valid while stocks last, and special offers only last until all of such stock has been sold out, even if the promotional end date is specified as a later date.
ROSALEE’S may withdraw the quotation without any prior notice or reason. ROSALEE’S may accept or reject in whole or in part any order placed upon it by the customer related to the quotation. Any variation to the quotation requested by the customer will make the quotation null and void and a new quotation has to be issued reflecting such variations.
PROOFING
You will receive a digital proof for your approval. To ensure that your design, colours, and wording are exactly how you want them to be, 2 free rounds of changes are included with each order. Any changes to your design must be indicated clearly. Should further proofs be required, a fee of R150 per additional proof and/or change to artwork will be applicable. Additional proofs will also affect the turnaround time and delivery date.
It is the customer’s responsibility to verify that all details on any proof is 100% correct before approving it. This includes contact details, images, font types, text etc. ROSALEE’s shall not take responsibility for any mistake on the final product if the customer has approved the preproduction proofs.
Proofs will be e-mailed to the customer in jpeg or PDF format. ROSALEE’s only accept approval via e-mail. Verbal, telephonic and WhatsApp approval will not be accepted.
Should a physical product be required for proofing purposes, a sample-fee of either R150 or 150% of the product value, whichever is greater, will apply. If no further changes are required, the sample-fee will be deducted from the total order value.
ADDITIONS AND/OR CHANGES TO SCOPE
Once a project has commenced, a certain allowance is made for additions and/or changes to the scope of the project. If a significant amount of additions and/or changes takes place, ROSALEE’s may halt the project for re-costing. The project will continue once the costing has been signed off and agreed upon. A revised completion date will be communicated.
TURN-AROUND TIME
Turn-around times published on this website are indicative only. More accurate deadlines will be confirmed with the customer upon quotation and/or order. Indicative turn-around time for design work is 3-5 working days. Thereafter, production takes 7-10 working days. Turn-around times are affected by material availability, size of order (quantities), order details etc.
A rush-fee of either R100 or 10% of the total order value, whichever is greater, will apply to orders that are required earlier than the specified delivery date.
PAYMENT TERMS
A 50% deposit of the total amount stipulated on the quotation becomes payable immediately on acceptance of the quotation. The remaining balance, including shipping costs, must be paid in full before products will be dispatched. ROSALEE’s reserves the right to wait for funds to clear in our bank account before shipping out products.
PAYMENTS
ROSALEE’S are committed to provide secure online payment facilities. All transactions are encrypted using appropriate encryption technology.
Payments for goods can be made via:
- Credit card: we may require additional information when payment is made via credit card in order to authorise and/or verify validity of the payment. In these instances, we are entitled to withhold delivery until such time that requested information is received by us and authorisation is obtained for the amounts. If authorisation is not received, the order for goods will be cancelled. You warrant that you are fully authorised to use the credit card supplied for purposes of paying the goods. You also warrant that your credit card has sufficient available funds to cover the costs incurred as a result of the services used on the website.
- Direct bank deposit or electronic funds transfer (EFT). If payment is made via direct bank deposit or EFT, payment must be made within 3 days of placing the order. ROSALEE’S will not accept the order if payment is not received timeously. Please note a 2% levy is charged on cash deposits and must be included in the total amount paid.
No Cheque Payments will be accepted as a method of payment by the supplier.
SHIPPING & DELIVERY
Delivery charges are always carried by the customer unless specifically stated otherwise on the quote.
ROSALEE’S make use of the following shipping options:
- Postnet Courier (PostNet2PostNet) at R100 per order. This rate applies to parcels up to 5kg. Postnet calculates the size of a parcel on either physical or volumetric weight, whichever is the greatest. An additional R20 is added for each kilogram in excess of 5kg. Delivery will take place between 2 to 3 working days. Please allow an extra day for outlying areas.
- Courier (The Courier Guy) at approximately R115 per order. This rate applies to parcels up to 15kg.
- Collection of Goods – Goods may be collected from our premises if arranged prior to collection. It is however, our policy to have the goods delivered and this option will only apply in exceptional circumstances.
Volumetric weight is calculated by multiplying the length, breadth and height (in centimetres) and dividing this by the applicable volumetric conversion factor which is 5000.
If you are not sure which delivery option will apply to your purchase, please contact us for a separate quotation. Shipping / Delivery cost must be settled in full before delivery will take place.
As printing and wooden products often results in heavy shipments, ROSALEE’S reserves the right to choose the specific service depending on the area and size of parcel.
Please make sure that you provide the correct shipping details and are reachable on the delivery date. ROSALEE’S will not be held liable for failure to deliver your products due to incorrect shipping details provided by you or failed delivery on customer’s part where the customer is non reachable at the provided address after two delivery attempts.
It is the responsibility of the customer to inspect the condition of cartons/parcels delivered as well as verify the number of parcels delivered with the number indicated on the waybill. In the event of parcels delivered in damaged condition, the customer should either refuse to accept delivery, or make a clear note in pen stating ‘Parcel damaged – contents not checked’ and notify ROSALEE’S of such damages within 24 hours. ROSALEE’S shall not take responsibility for parcel shortages or damages not indicated by the customer.
Whilst courier services contracted by ROSALEE’S do boast a good track record for timeous delivery services, allowance must be made for unforeseen circumstances (hijacking of vehicle, breakdowns, weather conditions etc.). Any delayed delivery by a third-party courier shall not be considered non-delivery by ROSALEE’S, and shall not constitute grounds for cancellation of orders.
CANCELLATIONS AND/OR RETURNS
At ROSALEE’s, we want you to be 100% satisfied with your order. If you are unsatisfied in any way, please contact us.
Cancellations:
All orders where deposits have been paid shall be considered fixed orders and non-cancellable. Refunds for cancellation shall be at the sole discretion of ROSALEE’s and a 25% administration fee may apply for time spent or resources used in the event of any refund.
Returns of Off-the-shelf / Standard products:
Off-the-shelf products (not customised products) that you are not 100% satisfy with, may be returned. Please notify us within 2 working days after receiving your order by mailing louis@rosalees.co.za. Please quote your order number which you will find on your order confirmation email and your full name. Please explain the reason why you want to send your item(s) back. If an item is faulty, please provide full details. Please explain the problem or defect and include photographs, if possible, so that we may best assist you.
Returns of Custom products:
For all custom designed, and made to order products, we will go through an approval and revision process to ensure that you are completely satisfied with all aspects of the design before going into production. You are responsible for checking the colours, spelling and grammar before approval. Once we have your approval, we will proceed with production. Custom designed and made to order products therefore cannot be returned. In the unlikely event that your products do not match the approved proofs, please notify us within 2 working days by e-mailing louis@rosalees.co.za. Please quote your order number which you will find on your order confirmation email and your full name. Please explain the problem and include any photographs if possible so that we may best assist you.
Cancellations by ROSALEE’s:
ROSALEE’S reserve the right to cancel orders without any prior notice or reason. In the event that we’ve cancelled an order and payment has already been made, you will receive a full refund of the value paid. The refund will be paid via electronic funds transfer (EFT) into a bank account of your choice within 5 working days after the cancellation.
Faulty products:
Goods are classified as faulty if they are received damaged. Please report any shortages or damages within 2 working days by e-mailing louis@rosalees.co.za. Please explain the problem and include photographs, if possible, so that we may best assist you. Replacements can only be made once we have determined that there was a product defect or damage caused during transit. If you did receive a faulty item, we will arrange a pick up of this item free of charge and arrange for a replacement to be sent or a refund to be processed.
HOW TO RETURN:
Please mail us at louis@rosalees.co.za within 24 hours. Please quote your order number, full name and contact number. Please explain the problem and include any photographs if possible so that we may best assist you.
The customer is responsible for the shipping cost (except in the case of faulty items). We will arrange this on your behalf and will deduct the amount from your refund.
All items must be returned in the condition that you received it, with all tags still attached and box packaging included where applicable. The item must be unassembled and unused and in a sellable condition. Please pack the item including all packaging you received the item with (bubble wrap, carton, etc.). Please post back to the following address: Sharalumbi Estate no 95, Farm Buffelsvley, Lydenburg, 1120. You will receive an email confirming that we have received your return and that you have been credited. All returns will be credited in the form of a voucher to use on our on-line store.
PROMOTIONAL MATERIAL
You agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate any comments, feedback, creative ideas, suggestions, proposals, plans, or other materials sent to ROSALEE’S. You agree that ROSALEE’S may use your products for marketing purposes.
ROSALEE’s reserves the right to photograph all completed designs and/or products and reserves the right to use such photographs for publication, exhibition and/or other promotional purposes. You agree that ROSALEE’s may share these images on any social media platform.
PERSONAL INFORMATION
ROSALEE’S Privacy Policy is incorporated and made part of these Terms and Conditions. You hereby agree to such Privacy Policy. Any personal data (for example, your name, address, telephone number or email address) you transmit to the Site by electronic mail or otherwise will be used by ROSALEE’S in accordance with the Privacy Policy. Any other communication or material you transmit to the Site, such as questions, comments, suggestions, or the like, will be treated as non-confidential and non-proprietary.
